1. Acceptance of Terms
By creating an account on FarmersBay ("the Platform"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please do not use the platform.
By ticking the agreement box on the sign-up form, you confirm that you have read, understood, and accepted these terms.
2. About FarmersBay
FarmersBay is a smart farm management platform designed for Zambian farmers. It provides tools for:
- Crop planning, tracking, and harvest management
- Livestock and herd management
- Financial records, receipts, and expense tracking
- Real-time market price information from Zambian markets
- AI-powered farm advisory and guidance
- Worker and task management
- Insurance tracking for crops and livestock
3. Account Registration
- You must provide accurate, current, and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must be at least 18 years old to register.
- FarmersBay reserves the right to approve, reject, or suspend any account at its discretion.
- You must notify us immediately of any unauthorised use of your account.
4. Acceptable Use
You agree to use FarmersBay only for lawful purposes. You must not:
- Provide false, misleading, or fraudulent information
- Use the platform to violate any Zambian or international laws
- Attempt to gain unauthorised access to other accounts or systems
- Interfere with or disrupt the platform's operation
- Use automated tools to scrape or extract data from the platform
- Share your account credentials with other people
5. Subscription Plans and Payments
- FarmersBay offers free and paid subscription plans (Standard, Pro, Enterprise).
- All fees are charged in Zambian Kwacha (ZMW).
- Payments are processed via mobile money (MTN MoMo, Airtel Money) or other supported methods.
- Subscriptions are activated immediately upon successful payment confirmation.
- Subscription fees are non-refundable once the plan has been activated.
- FarmersBay reserves the right to change pricing with at least 30 days notice.
- Promo codes may not be combined and are subject to their own terms.
6. Your Data
Your farm data belongs to you. FarmersBay will not sell your personal or farm data to third parties. We use your data only to provide and improve the platform services. See our Privacy Policy for full details.
7. AI Advisory Disclaimer
The AI Farm Adviser on FarmersBay provides general agricultural guidance based on the information you provide. It is not a substitute for professional agricultural advice from a qualified agronomist or veterinarian.
FarmersBay is not liable for any farming decisions, crop losses, livestock losses, or financial losses arising from reliance on AI advisory recommendations.
8. Insurance Information
FarmersBay provides tools to help you record and track crop and livestock insurance policies. FarmersBay is not an insurance provider and does not underwrite any insurance policies. Any insurance proposals facilitated through the platform are subject to the terms of the relevant insurance provider.
9. Market Price Information
Market prices displayed on FarmersBay are for informational purposes only. Prices are sourced from available market data and may not reflect exact current market conditions. FarmersBay does not guarantee the accuracy of market price information.
10. Intellectual Property
All content, design, code, and branding on FarmersBay is owned by FarmersBay and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without written permission.
11. Limitation of Liability
FarmersBay is provided on an "as is" basis. We do not guarantee uninterrupted or error-free access to the platform. To the maximum extent permitted by law, FarmersBay shall not be liable for:
- Loss of farm data due to technical failures
- Crop or livestock losses based on platform recommendations
- Financial losses arising from market price information
- Any indirect, incidental, or consequential damages
12. Termination
FarmersBay reserves the right to suspend or permanently terminate accounts that violate these terms, without prior notice. You may close your account at any time by contacting our support team. Termination does not entitle you to a refund of any subscription fees paid.
13. Changes to These Terms
FarmersBay may update these Terms and Conditions from time to time. We will notify registered users of significant changes via email or in-app notification. Continued use of the platform after changes constitutes acceptance of the updated terms.
14. Governing Law
These Terms and Conditions are governed by the laws of the Republic of Zambia. Any disputes shall be subject to the jurisdiction of the courts of Zambia.
